Receiving a traffic violation can be frustrating and time consuming, but with the help of the right attorney, the process can be painless.
Most moving violations will result in the driver getting one point on their DMV record. If you have four points in a 12 month-period, 6 points in 24 months, or 8 points in 36 months, you will be considered a negligent driver and may lose your privilege to operate a motor vehicle.
Traffic Infractions
Most minor traffic offenses are considered infractions. Infractions are not criminal violations of the law and carry relatively minor penalties such as fines, and/or points on your driving records. Though every infraction is different; each does require the officer to come to court and testify as to what they witnessed and why you may be guilty of that infraction.
If you see an “I” that has been circled to the right of the violation code, then you are being charged with an infraction.

Traffic Misdemeanors
Unlike an infraction ticket that is handled in traffic court, a misdemeanor is handled in the Criminal Division of the court house. A misdemeanor is a serious criminal offense that is punishable by jail time of up to one year, includes higher fines, and the possible loss of one’s driving privileges. The court may also impose other penalties, such as required enrollment in a substance abuse treatment program or other program, victim restitution, license suspension, and probation.
Misdemeanor charges need to be taken very seriously!
A misdemeanor charge should not be handled on your own. It is best to have an experienced and skilled attorney to handle your case and attend all your court dates. With an attorney, it is possible to have your misdemeanor charge dismissed.
Common Traffic Misdemeanors Include:
- Some cases driving over 100 mph
- Driving without a valid license
- Driving with a license that has been suspended or revoked
- Refusing to present a license when requested by an officer
- Fleeing from an officer, including causing an injury while fleeing
- Reckless driving, including reckless driving leading to bodily injury
- Engaging in a race with another vehicle on a public highway, including racing which leads to bodily injury
- Causing bodily injury with a vehicle after a license has been suspended or revoked
- Possession of alcohol in a vehicle by anyone under 21
- Possession of an open container of alcohol in a vehicle (if third or subsequent violation)
- Hit and run accidents
- Driving under the influence of alcohol or drugs (can also be charged as a felony)
Traffic Felonies
Felony traffic offenses are the most severe type of traffic offenses that carry extreme consequences including years in state prison.
